A MyFoodAllergyTeam Member asked a question 💭

I found a preschool, but it isn't nut free and they WON'T administer an epipen, but would just call 911. I'm so mad, is this legal? Is there anything I can do?

I think that's illegal. I think there is a good Samaritan law that will enable them to do the right thing (administer) w/o fear of a law suit. My son's kindergarten teacher had the same response initially. I explained that the law was on my side and I would force the issue if need be. She got trained. That was 15 years ago.

Contact a lawyer. An Epi-pen is a reasonable accommodation under Section 504.

Teach your child to use it themselves. Ask for the epi pen that talks them through it.

I agree. I was just so frustrated. We pulled her out & got our deposit back. Still looking for a new school....
